How to Comply with New ‘Sick & Safe’ Law

It goes live on 2/11, but a new bill might delay for 60 days

Maryland contractors are bracing for the implementation of the Maryland Healthy Working Families Act* (aka ‘Sick & Safe’). Hours must be accrued for eligible employees starting February 11, 2018.  But given the often-lengthy procedures for implementing new regulations, it could be months before state investigators have guidance on how to enforce.

As of February 8, 2018, the Senate has advanced a bill to delay the Act’s effect until July 1, 2018, which is expected to face considerable opposition in the House.

The Act requires employers with 15 or more employees to provide one hour of paid sick leave for every 30 hours worked to eligible employees, and employers with 14 or fewer employees must provide one hour for every 30 hours of unpaid sick/safe leave to eligible employees. The maximum sick leave time provided per year is 40 hours and it can be carried over to the following year with a maximum of 64 hours.

But the delay in issuing regulations doesn’t mean that contractors should not take steps now to comply.  All employers should begin to accrue hours for eligible employees and plan for changes to existing paid leave programs as well as providing notifications of a new act to the company’s employees.
